whether shamlat thok property, mustarka malkan with names of owners in possession of owners jointly considered as gram sabha or deh property.

Shamlat thock property with words mustarka malkan is the joint property of the owners shown therein though erroneously the same has illegally been shown vested in Gram Sabha. Recently Punjab & Haryana High Court has given a landmark judgment vide which allocation of such land to landless labourers by Gram Sabha has been dropped and has declared that the ownership of such land rests with mustarka malkan and not to Gram Sabha.
