About partition suit delay

Dear All Members,
I would like to ask you that my father files partition suit against my grandfather becuse of my uncle takeover some property of my grandfather , my gradfather agree to partition among all my uncles and my aunts, my grandfather 's age is 103years but court delays matter, what should we do???

The Court's process would take it's time. The Fact that your grandfather is that old is of no consequence. The proceedings would very well go in his absence also. If you guys are at consensus now - get a consent decree passed on basis of compromise. Otherwise I am afraid you'd have to contest

It shall be better to get the matter fixed before permanent lok adalat which works daily at all court complexes and your matter shall be resolved on the same day if there is no dispute and all parties comes to a compromise.

You can carry out out of court settlement by entering into a Memo Of Compromise and then can file the same in court.
