(Querist) 31 October 2011 This query is : Resolved
what is the time period to file an appeal if the decree is passed in a summary suit? please let me know the provisions also....
prabhakar singh (Expert) 31 October 2011
Article 116 of Limitation Act 1963 should be considered the relevant article where under if the appeal lies before High Court the period of appeal prescribed is 90 days and if
the appeal lies before any other court which would obviously be district judge then the limitation would be 30 days to be counted from the date of decree or order excluding the period taken by the court in preparation of the copy.

In one of the cases, wherein 1st appeal was preferred in the State Commission and order passed and read by the appellant but waqs not signed or copy taken. Now after a lapse of 8 months he wants to get the order reviewed on some points which were not touch upon or decided properly. Can he go for it? If yes, how?
