Electric pole

Querist : Anonymous (Querist) 02 September 2011 This query is : Resolved
Sir,
There is an electric pole in the backyard of my house that may prove dangerous anytime as it is about to fell coz of rotting at the base. Now that i approached the authorities, they are saying that they will erect another pole at the same place but will not shift the place of pole as there is no other alternative for this. And there is infact no other alternate place to erect pole. But since neither the land has been acquired by the department for the purpose nor they have any right over it. plz advice me how can i get rid of that electric pole?

When a utility company, like a power company, require under or above ground lines or poles to be installed on private property, a utility easement must be created. A utility easement is defined as limited property access designed for a utility company to build and maintain above and underground utility infrastructure. The property owner retains all rights to their land, which includes the easement. However, the utility company, city, state or town has rights to access the private property where easements are created.

Hope fully there is an enactment in this regard but unfortunately I am missing its name.
