Querist : Anonymous (Querist) 23 August 2011 This query is : Resolved
Hi,
My father passed away recently, he dint have any will....he had invested in mutual funds and lots in shares, The nominee for the same is my stepmother , does tht mean the she gets all of the same and we (class 1 heirs) have no claim to it, as she insists they atre all hers as per the law? Kindly help us with the law. We are all residing in Delhi.
My Step mother suddenly came out with a will which was made 25yrs back when they got married stating tht all my father owns should go to her....DOES THAT STILL HOLD GROUND???? CAN THT BE CONTESTED??

Nomination does not mean that a nominee has any right to discard other legal heirs of a person who died intestate, according to law a nominee is under obligation to account for and share with all heirs all those properties of deceased coming in his/her hand because of being nominee. If there is any dispute, other shares may move to court for succession certificate as well as for injunction against
nominee, companies,mutual funds,banks ,lic,post offices etc.,in whose hands
deceased properties are.
Challenge the will as fabricated and forged document.

As you state you are from Delhi,i advise you to go in touch of one of the best legal expert available to you who is here on this forum known by name Mr.R.Ramchandran.visit his profile and consult him personally after fixing an appointment with him.
