Money suit- Statutory provision

Dear Advocate Arunagiri,
Thanks for reply. Believe me, whatever was stated in my earlier query was not imaginary. Mentioning of provision of law may not perhaps be necessary; but this suit was registered without mentioning provision. It is quite natural that my query appears contradictory. Sorry. In this suit, I sought attachment of the share of Deft.1 in common property and therefore, his co-sharers are joined. Suit proceded exparte against deft.1; but one of the other defendants gave his written statement, and therefore, it is posted for final arguments.

As said by Expert Mr.Devjyoti Barman, I told to the Court that the suit is one under Sec.9 of the C.P.C. However,the Court asked me whether you filed this suit under Negotiable Instruments Act OR Contract Act OR Specific Relief Act?

Provisions relating to suit matter is though not necessary to be mentioned in civil suits but plaintiff should very much clear about his case and provisions under which the same has been relied upon and has to proceed accordingly.
