During the evidence u/s 244(1) of Cr.P.C. CAN Prosecutor can lay FRESH EVIDENCE ON THE RECORD AS EVIDENCE BEFORE CHARGE.

What do you mean by fresh evidence. The procedure is for evidence before charge by examinin the witnesses who are mentioned in the list of witnesses. Now the complainant can not bring a new witness without the permission of the court.

However evidence in respect of clarification of pre-summoning evidence can be given u/s 244 Cr.P.C. even without permission of court.
