The Respected Jurist
1) I Have Heard that a word "Public Prosecutor" can be used in criminal cases or procedings only & not in the civil case why so ? (1a) In civil cases the opposite advocates is called out by what name if not public prosecutor ?
2)Can anybody send me the copy of the belowmentioned case law which explains the meaning of non - obstante clause in details.
SC In South India Corp Ltd vs. Secretary, Board Of Revenue (1964) 15 STC 74.
Also more opinion required for non - obstante clause.
3) Can anybody can say why we write doctrine or maxim for the words ? How do we know that we have to write the doctrine or maxim before the particular word or a sentences . Every precise meaning of word doctrine & Maxim used why ?
Pls Answer the abovementioned query .

Public Prosecutor is appointed u/s 24 CR.P.C by Central/State Govt. for conducting prosecution, appeal or other proceeding on their behalf. In Civil Case the term is Govt.Pleader or Counsel. Doctrine or maxim are settled principle of law applicable to all acts and rules. if you are acquainted with the meaning of the particular maxim or doctrine then you can use the said term to give force to your submissions. Your last query is not clear, what do you mean to ask?
