sale without katha

(Querist) 28 October 2010 This query is : Resolved
Our mother died intestate leaving behind 6 children. She had self acquired property of land and building. Father died before mother expired. Can the legal heirers, I mean children of the parents sell the property without any katha jointly, as there is absolutely no understanding among children to transfer the property to one child. Selling jointly by survivors is aggreable to all children.
Devajyoti Barman (Expert) 28 October 2010
If no partition has been made between the co -sharers then they could transfer the joint property in conjunction of all of them.

I agree.
