I am representing vehicle owner (Respondent)in a claim petition (Death Case)Vehicle is insured but fitness was expired on the date of accident.Sir,what is effect of expiry of fitness in claim petition,kindly advice.Thanx

If fittness certificate is not renewed it amounts to violation of insurance policy condition, owner will be held responsible if ins., co., contested the case on that ground. IN this case fittness certificate is expired on the date of accident so it does not amounts to violation insurance policy conditions. so contest the case on this ground.
