(Querist) 03 December 2015 This query is : Resolved
Dear experts, my wife file DV case against me but I am trying to get back her my home from before the filling the case. But she denied it. She wants to come back on her conditions like to go anywhere or heavy pocket money which is not possible for me. I want that she come back without any conditions. She says I will get maintenance from court and not want to stay with you. I have also a daughter of one year old. Will she can get maintenance on these ground? Please help me on this matter.

don't put any condition upon each other, live your life peacefully, convince her and get her back with you otherwise your most of the precious years will spoils in the cases, if your wife is not a working woman then you have to pay maintenance for her and for your child also .

Try to have amicable solution. For the time being there seems no harm in accepting genuine demands and should try to save your marriage. Try to forget ego as in the court proceedings / police case, it may hurt time and again. Take help of relatives and common family friends. If this does not work, court would remain there.

If she has no source of income, court may award payment of maintenance. You are also liable to pay maintenance for your daughter.

If your wife is not employed anywhere, then she is entitled for maintenance.
