criminal case registered against a Government employee

(Querist) 01 December 2009 This query is : Resolved
It is submitted that a central Govt employee was on casual leave. there was some dispute with his neighbours. An FIR Under Section 452, 254, 506, 323 was lodged against him. What kind of disciplinary action has to be taken by the Govt Department ?
Manish Singh (Expert) 01 December 2009
it's nothing to do with the disciplinary action by the department at this time. unless the the court awards him a sentence, no disciplinary action lies which shall also depend upon the outcome of the case.
Raj Kumar Makkad (Expert) 01 December 2009
Department can suspend you initially on the receipt of the intimation either through court of jail authorities as the case may be and can also issue you show cause notice and serve charge-sheet thereon. The proceeding of criminal court has nothing to debar the department to initiate any departmental action under section 7 of CSR.
