We are a small scale engineering company and have dispute with a vendor about the supply of goods and services. The vendor is a medium scale company and has invoked section 18 of MSME act for recovery of payment.

Is a medium scale company entitled to seek relief under MSME Act against a small scale company? Is there a case law or settled position on this issue?

there is a open law if any loss is appear by you then you can be liable to repay him.

Hello Mr Apte.

Filing of Claim Statement under Arbitration Act read with MSMED Act 2006 for delayed payment can only be filed by Micro and Small Scale Industries. The Act is very clear about it. Hence the Claim filed by your Opp- Party has to be dismissed. No Such situation has arose before any court, hence there are no such judgments that I am aware of.
