You must file the appeal against the impugned judgment within the stipulated time because the limitation is recurring in the given case which extends every day on the inaction of the builder.

Dear sir,
Last payment made to the builder on 27.06.2007 through icici bank loan. and i filled the suit on 30.04.2011 for specific relief act section 39.
and reminder to the builder is on regular basis on phone only.
i sent a mail also but in 2011. and a legal notice for the same.
so please suggest me what kind of suit i have to file against the builder and it would be under the limitation act.
or should i file a criminal case?
thanks for your suggetion
