IS THERE ANY CASE LAW AGAINST THE DEMOLITION OF PRIVATE CEMETERY BY GOVERNMENT AGENCY IN THE PRETEXT OF PUBLIC PURPOSE OR ROAD WIDENING?

Road widening is one of the important aspect of development of a country.

Demolition of cemetry, temples and other places of worships for road widening / construction of railway etc are not at all illegal.

In Ahmedabad, a mosque was left by a court order some years ago but the citation is not in memory whereas various temples and other private property coming in the way of same road had been removed.
