I had filed an application under Section 31 of RDDB Act before the DRT. The registry had directed me to pay the entire court fee as prescribed under RDDB Act. I said the court fee for Section 31 and 31 A applications are only Rs.250/-. I request my learned seniors to clarify the same. whether i can pay the entire court fee? ot not ? any citations please

Provided further that nothing contained in this sub-section relating to
fee shall apply to cases transferred to the Tribunal under sub-section (1) of
section 31.
You need not pay the full fee. That is not applicable to 31 application.

While filing suit the bank/FI would have paid court fee in civil court. While filing Application u/S 31 you need not again make payment of court fee. Any fees is not prescribed for Application u/S 31. Hence Rs.250/- would be enough for filing for execution of an earlier decree of civil court. If the civil court has transferred the case to DRT, then any further court fee is not necessary.
