In case the OP employer have filed the petition in the CAT raising the plea of Limitation and my version was that OP has made the concealment of result and I could not be acquainted with the status of result in year 2001 and came to know about the status of result in year 2007 only by the way of RTI Applications
On previous hearing The Hon'ble CAT has re-questioned the employer whether the result was notified? which he failed to explain
Now the bench has asked me why should I filed the RTI only in year 2007 and I relied upon section 17 of Limitation Act-(Effect of fraud and mistake) and judgments which relied that when employer is in fault it should not stand on limitation
But bench didnot satisfied it
KINDLY inform whether I can make appeal before High Court?
