Is there any section or authority is available in CRPC to amend the Affidavit of Evidence or Examination in chief fild in the court of law during trail?
Devajyoti Barman (Expert) 14 September 2010
The affidavit can not be amended though you could with the leave of the court file additional affidavit to clear any discrepancy or in the alternative withdraw the earlier one and file a fresh one.
s.subramanian (Expert) 14 September 2010
You cannot amend the affidavit once it is recorded by the court as your evidence. After that it becomes your deposition or evidence and does not retain the identity of an affidavit at all. If there are any ambiguities in it you can clarify the same by filing supplementary affidavit for your re examination under the Evidence Act.
s.subramanian (Expert) 14 September 2010
Of course you have to take the leave of the court for filing the supplementary affidavit of reexamination.
