Querist : Anonymous (Querist) 17 May 2010 This query is : Resolved
i would like to ask from learned legal fraternities that in our defence forces their is min. period of bond which a soldeir is required to serve or complete then only he is being discharged. this min. service period vary among all three services:army, airforce and navy. My qns is like this period of bond which is 20 yrs in airforce, is this period justified if yes what are constitutionally correct parameters for accounting or determining such period of service. That is what are the factors on which any service has a right to take hostage of its soldeirs for such a long period. Pl dont give any vauge answers as to amount of money spend bla..bla..bla...if amount of money is spent is the factor then how this expenditure is accounted, and if that is so why a soldeir is not intimated the correct expenditure so that if he has hasiyat...he would return such amount and leave this bondage labour.

As per my knowledge there is a provision to leave the services before the complition of bond period. One should have pay a certain amount to the govt. and he will be released from the service of Govt, on acceptence of his resignation with that amount, from the services.

Dear Mr. Anonymous,

(1) There is no compulsory military service in India. People apply voluntarily to get selected.

(2) The period of Bond exists in almost all the industries.

(3) There are also provisions available in Armed Forces for discharge (like application on compassionate grounds).

If one feels aggrieved by the rules, he can escalate it to higher authorities for incorporating necessary amendment in the Rules.
