applying through proper channel from employer

iam a staff nurse in jipmer since july 2008, an autonomous institute. iwould like to forward my application for state government posts through proper channel. does my employer has the power legally not to forward my application. If they are not forwarding my application what can i do? can i file a case against them

If your employer refuses to forward your application you can seek reasons for the same. If you are not provided with reasons you may approach the higher authorities and redress your grievances.

However, you need to present suitable facts in case of under-employment in JIPMER stating that your experience and qualifications warrant a career which would suit the new employment. In that case, JIPMER has to issue NOC and forward your application subject to Service Rules prescribed.

you send advance application to the prospective employer and file a copy of the application through proper channel. Once, you got selected, seek no objection certificate from present employer. If he will refuse to give no objection certificate without sufficient reason, then you have to move the court. First of all, check up your service conditions that whether there is any "lock-in" period in your appointment, which means, during the lock-in period, you are not entitled to go to some other job.
