statement through affidavit

In civil court is it admissable by court if any statement is given to court through ,presenting affidavits through lawyers ,or is it compulsary to present before court, personally,in a family partition related matter.do, both the ways have equal weightage or not?

All affidavits can be filed through lawyers and only affidavits (Proof affidavit filed during commencement of evidence) needs the personal presence of the parties before the court.

Any matter related to crime for Affidavit advocate is needed but in civil Matters it is optional.one can present affidavit who is appearing in person before the court. Affidavits are filed to authenticate the evidence of statement.One can not deny from that statement. if it is made forged and presented before the court it is punishable offence.Criminal liability imposed.

Affidavit and person both are required but evidence can be taken in the house of any person by court commission if such witness cannot come personally in the court subject to deposit of required fee.
