Consent for using land

(Querist) 11 October 2026 This query is : Resolved
1963: my father-in-law gave 6 cents to Kudikidappukars - sale deed. . 41 sq mtrs (about 1 cent) at back side is still in father's Thandaper, with survey number. It is NOT in the 1963 sale deed. - But since 1963, they were using that 41 sq mtrs + 3 cents Puramboke near river. - 6 cents partitioned: younger brother got front side (road), elder brother back side adjacent to river - Elder brother sold his 3 cents + house in 2026. His house is encroached into this 41 sq mtrs. - Now new buyer wants to regularize that 41 sq mtrs. Younger brother also wants it for keeping boat and nets. - Father-in law expired in 2012 - Is there any problem if we give a consent to new buyer for this 41 sq mtrs.
Quick Summary
A family is seeking consent for a new buyer to use 41 sq mtrs of land that has been in their possession since 1963, though it was never formally included in a sale deed. This land, adjacent to a river, was originally part of the father-in-law's property and is separate from 6 cents that were partitioned between brothers. The new buyer's house encroaches on this land, and they also wish to use adjacent government puramboke land. The family needs to know if giving consent will cause legal issues, especially as the original owner passed away in 2012.

You stated that 6 cents were partitioned between a younger brother and an elder brother. How can they partition 6 cents if they have no right except 41 sq.mts. They have been using the land of 41 sq.mts., since 1963. Does it still stand in their name? Did you verify the revenue records? And do the 3 cents of Poramboke land near the river belongs to government or is it in the name of brothers?

My father- in law gave their father (kudikidappukar) in 1963. Back of that 6 cents my father-in- law has 41 sq mtrs o land adjacent to river. As per revenue records it is in the name of father - in-law and separate survey number. They are using it since 1963. Now they partioned the 6 cents and elder brother's son sold his share of 3 cents to another party. The new buyer wants to use this 41 sq mtrs along with 3 cents of puramboke. His house encroached in this 41 sq mtrs. Puramboke belongs to government.

Your father-in-law gave the land of 6 cents to Kudikidappukar in 1963 through the sale deed as per your statement. So he was not the owner of those 6 cents of land. How did they partition the property if they were not the owners? Your father-in-law had another land of 41 sq. m; what was the survey number, and what was the nature of the 41 sq.mts. land? Engage an advocate in your area and show all the documents and papers you have, and proceed as per his guidance.
