Querist : Anonymous (Querist) 23 February 2010 This query is : Resolved
hi, i have a old tenant in my property who is in possession of the said house since last 50 years. now i am planning to develop my entire plot wherein he is the only tenant to be evicted. how do i go about all this. what settlement options do i have with me?
niranjan (Expert) 23 February 2010
For the purpose of deveoping the property you cannot evict the tenant, but if you are ready to give him back the equal space as is being utilised by him after the property is developed, you can file an application under rent act and can get the property for development.

You can file an eviction petition/suit against your tenant by stating the reasons.
Parveen Kr. Aggarwal (Expert) 23 February 2010
If the property is situated within an urban area and Rent Control Act applies thereto, you will have to file eviction petition under that Act. Otherwise, you may institute suit for possession after serving notice under section 106 of the Transfer of Property Act, 1882.
