A person has purchased property when a partition suit was pending in court. But the purchaser did not have the knowledge of the pending suit and the seller also claims that he had not got even summons from court at the time of regitration of property. Now the purchaser has pleaded himself to be a necessary party in the case. Does lis pendence apply in this case. Are there any case studies, citations to protect the interest of the purchaser ?
