U cannot get the custody until the girl completes 5 yrs.But have visitation rights.Once she completes 5 yrs,U can file an application for grant of custody of the daughter,but the mother may contest also.

As per the proviso to section 6(a) of the Hindu Minority and Guardian- ship Act, "the custody of a minor who has not completed the age of ﬁve years shall ordinarily be with the mother". But the father will have visiting rights.
