Service tax receiver liability - reg.

Respected Sirs,

Some of the vendors are not registered under Service Tax registration (we assumed that, the services are crossed more than Rs.9.0 lacs).

We are taking the services without payment of Service tax to the vendors.

Because that vendors are not registered under ST and not claimed the service tax amount on their bills.

Being a service receiver what is our liability....?

Please suggest me.

Except where reverse service tax applicable (like advocate fee in some cases), the liability is of service provider. They have to explicitly bill the service tax. For safety you can always ask for an affidavit / undertaking / indemnity where they declare service tax not applicable.
