Sir,
I am from Hosur (Tamil Nadu), we made a sale agreement with buyer for an agriculture land in Tamil Nadu. This sale agreement is registered in sub registrar's office and appearing in encumbrance certificate. The preset buyer not ready to buy the land and wants his money back. By mutual understanding we are planning to cancel agreement.
Please tell us what is the procedure to cancel sale agreement which is registered. How to cancel it from encumbrance certificate. Thanks

A cancellation deed to be executed by the proposed buyer.Which could be drafted by an advocate or by some experienced document writers at Registrar Office.Try to expedite same as early as possible when the buyer is ready to co-operate.

Yes the registered cancellation deed cancelling the registered sale agreement deed will automatically take care of the encumbrance in the property.
