I am the power of holder of Mr.A. I have filed a suit for declaration, temporary and mandatory injunction. Defendant No.1 purports to be the power of attorney holder of Mr.B. this Mr.B claims to be the co-sharer of the property of my principal for which i have been appointed as the attorney. now the question is do I as attorney holder have a right to sue. the opposite counsel has moved an application under order 7 rule 11(a) stating that I(plaintiff) do not have any cause of action as my right is not being violated.According to him it is my principal's right that is being violated. can anyone please help with a suitable judgment as i have been directed to produce one by the Hon'ble court.
