Bail under sec 135(1)b

(Querist) 02 February 2013 This query is : Resolved 
sir the magistrate court has the power to enlarged the accused on bail u/s 135(1)(b) of the elcectry city act 2003 because when i given the application so court said that only special court has the power to enlarge accused on bail, while other lawyer advised that, accused can be anarge by the magistrate because it's a pri trial process so is right and how i convince the court?

It is triable by sessions court only.
Deposit the default amount and apply for bail.
