Criminal trespass.

(Querist) 11 October 2012 This query is : Resolved 
I have a tenented office consisting of
3 small rooms of 100 sq ft each. Third
party has trespassed into one room and
has put his lock and has kept it locked.
I made police complaint, but police has not registered FIR. Please advise criminal trespass is a cognizable offence or not and whether the police is required to register FIR. Also please advise what
remedy is available to me.

File a petition u/s 156(3) crpc before the concerned Magistrate under whose direction the case of criminal trespass would be started.
Thereafter file civil suit for eviction of the trespasser.
