Token monry back

Hi,
I gave a token money of Rs. 101,000 thru cheque to purchase a land on dt. 12-may-12 & date of purchase was 12-July-12. The saler was not came on that on 12-July for sale the land & i was present. Now i want to back my token money.
What should i do?

Send a legal notice to him thereby asking him to refund ur money at once.

@ Nanda Sir my agreement was not notarized. so it make any legal effect...

Yes, Agreed with Shri Nanda.

First issue Notice, Demand Specific performance, failing which demand your amount with damages and interest, say Rs. 2,50,000/- or today's price.

If no reply, file Civil Suit for Specific Performance, Injunction, restricting him to create any third party right, Attachment of Property before Judgement, and refund with damages and interest as alternate relief.
