Law of contracts

(Querist) 15 June 2012 This query is : Resolved
Whether a trust is competent to enter into a contract with a private limited company?the company is in illinois,U.S.A and the trust is in india.pls explain under what provisions of law it is possible?
Adv.R.P.Chugh (Expert) 15 June 2012
Dear Supriya,

Absolutely. Both are entities competent to contract. But the contract should not be such as is in contravention to the trust deed itself, the trustee can enter into contract on behalf of trust as allowed by the trust deed expressly or by necessary implication. Other Contracts are ultra-vires.

You don't need any provision of law for this
