Power attorney

(Querist) 02 May 2012 This query is : Resolved
How to revoke power of attorney? Is there any procedure to give notice before revoke or after revoke of power of attorney to the POA holder or registered revocation of power of attorney is sufficient?
Adv.R.P.Chugh (Expert) 02 May 2012
Power of Attorney is one of the ways in which Agent-Principal relationship is established that enables the agent to represent principal in his dealings with third persons in his representative capacity.

POA can be revoked by :-
1) Notice
2) Death
3) Insanity etc. of Principal.
4) By lapse of time
5) Breach of Conditions amongst-others.

As a POA is not required to be registered compulsorily - there is no reason why a revocation should be registered.

Remember in a Agency coupled with interest - revocation cannot be done.
