Builder not formed society

(Querist) 18 March 2012 This query is : Resolved 
Builder has not formed society and has not given any handover and suddenly stopped maintenance of our society at Ghodbunder Road. Some of our members are now managing the society. We recently received bills of Property tax.
I would like to know, can we take any action against builder for not forming society and not giving Handover. Also if society is not formed, who is entitled to pay Property tax?

ISSUE NOTICE TO BUILDER TO FORM SOCIETY.

Under MOF act sec 12, builder is bound to pay all outgoing, and manage society
