Dear Experts, In execution proceedings under O21 R2, the objections under O21 R97 raised by JD was upheld and execution petition dismissed by the court. Can a proper/better remedy to go for a review or an appeal . In case the review is filed and subsequently review application not allowed, will there be possibility of filing a first appeal in Distt. Court, after review fails.

Kindly advice. regards

No appeal lies against dismissal of revision application rather a writ lies.

Respected Makkad Sir:
It is the execution application which was dismissed by lower court and not a revision application as replied. Kindly please guide.. Whether better option is to go for a review or an appeal, in case of dismissal of execution application under O21 R97.Thanks for the prompt reply of my prevous query on the subject.
