In my case the charge sheet issued is invalid (not issued by competent authority and charges are vague and nonspecific, material relied is not appended) still the corporation has continued with inquiry and terminating employee. Is it sufficient to prove in the court that charge sheet is invalid and so whole action is vitiated and get it quashed

Your query is not clear sir.. How ever you have to prove your case before court only. Whether is it valid charge sheet or not..

you are asking the same under industrial dispute, labour law category. For which contact your lawyer and he will guide you further in this matter.

In the rules of Corporation, if it is stated as, "who is the competent authority to frame charges", and if you are relying on such a rule that a competent authority has not framed charges your case,
you can assail the termination order and have it set aside.

thank you. My rule book clearly says who is my appointing and disciplinary authority. Moreover chargesheet is issued by a person who is not even employee/officer of corporation but has stated himself as inquiry officer.
