Triparty

Dear sir,

we have a plot which is given by govement for farmer which they name as 12.50% property.
we have given that plot for development to builder with aggement that after construnction he will take half part and we will get half part .means out of 30 flat he will get 15 and we get 15.and additional he gave some money per falt to us .
Now construction has started and my builder has sell his part to other people and now he is telling that those people who buy house from his not getting home loan.
so he is telling to do triparty,which we feel that is not correct.because it will give all rights to builder and we will be for the name sake.pl give me suggetion what to do for this ?

12.50% property is given by maharahstra goverment.in which they have taken our farming land and for that subsitute they have given new land to us.
is it ture that without triparty agreement people cants get home loan.
and if it is compulsary for home laon than how triparty agrrement should be made in the favour of us not builder.
