Labour supply tender accepted by A&N Command(PRINCIPAL EMPLOYER) and OUR Firm(CONTRACTOR), accordingly Rates fix up. In the tenure of execution of the contract, the GOVERNMENT changes Labour rate by Circular. Nothing mentioned in tender to get this hike rate. Now to assure Minimum wages of labour can we claim the difference from A&N Command which arises from Government circular?

Sir, no agreement made but Acceptance of tender given by the commanding officer on the basis of tender & PNC given to us. Accordingly we get monthly payment for entire period except the statutory changes of labour rate enhanced by the government.

Even if the agreement says about the old rates for wages (lower than the minimum wages), if the government revised the minimum wages, the government rule will supersede the contract terms.
