Cancellation of registered Sale agreement

Querist : Anonymous (Querist) 10 February 2011 This query is : Resolved
Hi Experts,

My friend entered into an registered agreement of sale with a builder about 6 months ago, with the 4 months agreement period;
1) The builder sent a hand written letter on company letterhead citing his willingness to register the property on 15th Dec 10.
2) Subsequent negiotiation: he is asking for reduction in agreed sale consideration under various pretext.
3)Agreement has expired 2 months ago.

Pls advice on the future course of actions and also how do we cancel a registered Sale agreement

Your friend cannot cancel the agreement and it will amount to breach on his part. Your friend will be liable for consequences for breach of contract mentioned in the agreement.

The builder can not ask for reduction in agreed sale consideration. The agreement is expired means the landlord can refund the advance received from the builder and can have a fresh agreement with any other party.

I completely agree with Mr. Arungiri .
