Power of attorney

(Querist) 23 December 2010 This query is : Resolved 
Hi, please solve the query given below :

Mr.A has a power of attorney of a house located at Delhi in his name now he wants to apply for flat in DDA Housing Scheme 2010 but Eligibility conditions include:-

"The Applicant must not own any residential plot or flat in his her name/spouse/minor-dependent child located in delhi."

Is Mr. A eligibile to apply for DDA Scheme ?

If A is only the attorney of that flat and has got no connecton with its ownership then he is eligble.

well,in absence of any clause that states MR. A can't sell the property and he is free to transfer the attorney .
what would be his status ?
still a attorney holder
or
Owner ?

Still an agent only and not the owner. Power of Attorney does not and cannot convey title over the property.

POA is agent and not the title holder, it is the terms and conditions set forth in the POA which describes more about the POA holder and this can be answered better with the construction of the POA.
