Inspection by civil engineer.

(Querist) 18 August 2010 This query is : Resolved
I filed a suit for damages against the leakages caused by the owner of flat above mine.

Should I file a separate application for inspection by civil engineer to assess the damages or is there some other procedure followed by court?

If your suit is based on torts all you have to establish is the fact of damages caused to you and the direct connection to that damage to the respondent and his duty of care to you this you can do in your private capacity without seeking any aid from the court

You can seek the appointment of a commissioner to visit the flat and note down the extent of damage with the help of a qualified civil engineer. That will help you very much.

Yes. U have to approach the court for appointment of Commissioner for local inspection preferably a civil engineer to assess the damage & report to court.
