hi! can any one give some case laws ,on the bail after surrendering in the court ,in the offence u/s 498-a,how much scope of bail is there? please suggest.

husband should apply for anticipatory bail before sessions court if FIR is registered. Other members of the family can suurrender before trial court and can get bail showing their role in the married life of the couple.

Granting of bail is the discretion of each court in its own way. If the petitioner is a husband then in Kolkata he is put behind the bars for 3-4 days in 498A cases. For the in laws they get bail on the same date when they surrender or brought to the court after arrest. I have found the Calcutta High Court very generous while granting anticipatory bail in 498A case.
