Giving prior notice u/s 80 of cpc has no application for a civil servant.

Yes for a public servant prior notice is of sixty days is required under Section 80 of the CPC if you are filing civil case and prior permission of the government is required under Section 197 Cr. P. C. if you are filing a criminal case.
