Proove of income

Respected Seniors , In application of 125 I have requested that my husband is earning 40K where as in his reply my husband is stating that he is earning 8to 10 K . My husband is noty having any Pan card so no ITR with me. Now I got his rent deed of his shop where he has agreed to pay Rs 4000 as rent and electricity bills extra . Is this proove of his expense will work that he is misleading to court about his income ? And I will get the maintenance as per my request in the application. Kindly advise .

Yes, show those documents. The court may work out any figure in between the two mentioned by both of you.

Rent agreement and bill for electricity do not prove the income of any person rather those are expenses.

Income means net saving after incurring entire expenses like rent, electricity, transportation, salary of any sale-man etc.

You shall have to bring convincing evidence in support of your claim.

Thanka for reply. This ia true that these r expenses. But by this can't we convince to the court that a person will pay this much expense s only when he is expecting the good income because after this rent he has to make the investment on machines and other salable material in the shop . This is a stationer cum photostate shop in a college and running this shop for last 5 years. A person who is running thia shop for 5 years can not stick to the same shop for 8 to 10k at present time. And for last 5 years college students has uncreaed about 4 tumes. Is this the right convincing to the court or not to prove my contention as his income ia 40 K. Kindly advise.

The points raised by you are not convincing though the court shall definitely pay attention to your argument. The court may deem the monthly income of your husband more than he disclosed.
