Gratuity eligibility

Hi, My date of Joining is 10th Oct 2008 and i am planning for resignation on 15th June 2013. Am i eligible for gratuity.

If you have rendered uninterrupted service as explained in Section: 2A (1) of Payment of Gratuity Act, 1972, you should be eligible.

Section: 2A
Continuous service.

(2) (a) (i) : 190 days = 1 year if the establishment is operating on 5days/week

(2) (a) (ii) 240 days in any other case.

Therefore you may take date of reference as 15th June, 2013.

Count 4 years from DOJ and then 190/240 days up to date of reference, in 5th year.
