Consumer act case....

i have paid a certain amount to builder as a token amount for booking of a flat 3 years ago. still now the builder has not yet executed an agreement in respect of the same.

my question is : -

1) can i file a consumer case for deficiency of service on part of builder??

2) is the consumer complaint within limitation??

3) case laws if any are required..
