Bungalow agreement

Q.my client was purchase one bungalow from developer.the owner of land make sale deed and developer construct bungalow as turnkey project.my client was given advance money by cheque to developer and developer make agreement with my client advance money received against turnkey proj.of that bungalow..
As this agreement is valid because sales deed of that land till date not on my client name..

If the landowner has sold the mad to Developer and thereafter the Developer entered into sale agreement with your client in pursuance of which he has received the money but is not willing to complete the sale then your client can after sending the Developer legal notice to pay the balance amount go the Consumer Forum and file a case u/s 12 of CPA for registration of deed of conveyance.

but sir i think i was not explain my question properly.i want to add in my Que..

Add:fisrt of all there is not any dispute betwn my client n devr and landowner not transfers land to developer there is separate deal with landowner n separate with devpr;my dought is without sale deed clients entered into contract with developer for construction on that land which is not in his name.

You being a lawyer know that a person having no clear ownership cannot further sale the property. Developer is not owner of land as on day so investment of your client is under risk.

Generally developers manage the land owners sooner or later but its ultimate burden shifts upon allottees.

As the stage of thinking over these points has already crossed so your client has been left with no other option to persuade the developer to get the title transferred in his favour as soon as possible so that your client may et registered sale deed in his favour on the basis of already executed agreement to sale.
