Change of name.

Dear Sir,
What answer i got from u is satisfactory till i dont sell the flat.After my grandmother death the name was easily got tansfer to my both aunts name and nominations to my uncle he beign elder.When my aunt died the society office said the second owner becomes the first and the first nominee becomes the share holder.but till my aunt was there alive she tried to change the name but she was asked to get NOC from my uncle that is her brother then only they can do it.
I just want to know is the Society people are beign bias to him or really there is some law which is abiding the society from doing this.
We have paying from so many years thae maintainence and any other tax which is paid to the society.As i want to give them letter for changing the name can u tell me the wordings as what exactly to be mentioned.
Can i deduct the money from his share if i am giving him which i have been spending all the years on maintenance/electricity/Yearly painting/Yearly leakage maintenence.
If i want sell the flat can i sell.

Mr. Merely entry in the register of the society do not give any ownership rights to any person. In the given facts, it seems that the management of society even do not know the basic concept of ownership. society maintains the names only for its maintenance or roll but the ownership is decided by civil court or any registered document. In your case, you should approach to civil court to get settled the matter of your long pending ownership issue. If you make further delay, the things shall be out of your control and in that situation you shall totally lose the share in the flat.
