Graduity payment

Hi

I am working in pune with one company from Sept 2008. When I joined it was partnership firm. In May 2010, two partner got split and form their own companies. I continued with one of them till now(July 2014). Nature work was same as before. Am I eligible to get gratuity as per the act?

Depends upon the No. of employees working in the company as well as your working with the company with the same name you were employed for originally.

Number of employees is more than 20. The name has changed but in the offer letter it is mentioned that "unnate's business is now restructured as MDS "

If you are working in the company with new adopted name, with 5 or more years of service with the company under old and new name you would be eligible for gratuity.

Consult local lawyer dealing in service matters and show him all the documents.

However, on the basis of given facts agree with expert PS Dhingra ji.
