Section 41d of the bombay public trust act

IF I FILE AN APPLICATION UNDER SEC 41D OF THE BPT ACT AND THAN WITH THAT I FILE A 41D(3). DURING THE HEARING IF THE TRUSTEES CONTINUE TO SELL AND DEAL WITH THE FUNDS OF THE TRUST WITHOUT THE CHARITY COMM PERMISSION, CAN I IN MY APPLICATION UNDER 41D FILE ONE MORE APPLICATION UNDER SECTION 41D(3)? AND IF I CANNOT THAN WHT IMMEDIATE REMEDEY DO I HAVE TO RESTRAIN THE TRUSTEES.

Get the interim order from the court to restrain the trustees.

s.41 D.of the Bombay-public trust Act relates to Suspension, removal and dismissal of trustees does not confer any power in commissioner to issue any injunction order hence to seek injunction against trustee a regular suit in civil jurisdiction shall lie.
